The 15th Annual UCC Law Conference surround Article 41.2 of the Irish Constitution
Free!
The Annual UCC Law Conference will take place on the 4th of November 2015 in the Aula Maxima in UCC. It is the largest student-run conference in Ireland which attracts approximately 220 people consisting of mostly solicitors, barristers and students.
This year, the focus of the conference is on Article 41.2 of the Irish Constitution, the “women in the home’ provision.
It reads: “In particular, the State recognises that by her life within the home, woman gives to the State a support without which the common good cannot be achieved.
The State shall, therefore, endeavour to ensure that mothers shall not be obliged by economic necessity to engage in labour to the neglect of their duties in the home.”
I believe the provision is in major need of reform and my aim with the conference is to have a discussion around the origins of the provision, litigation and controversies surrounding the provision, the effects of the provision on women in general and women in the workforce to include women in politics, men, families, same-sex couples, the effect it has had on social welfare laws etc., the human rights aspect of the provision particularly as it has been established that it is in violation of CEDAW, the need for a provision like this to protect those who do work and care for children in the home, the effects, both positive and negative, of any changes in wording to the provision and the future of this provision in modern-day Ireland.
I believe it is an issue which is consistently shoved under the rug and my aim with the conference is to create momentum for a positive change to the provision to come about.
